Hopkinton Woman Sentenced In Threat, Conduct, Stalking, Prisoner Assault Cases: Follow-Up

Sue Ellen Herrick, who has been in jail for months, will remain so for at least 8 months after a plea deal was reached in 2021, 2022 cases.

CONCORD, NH — A woman from Hopkinton, who has been in and out of jail since being arrested in December 2021 after threatening to kill her neighbors, has reached a plea deal.

Sue Ellen Herrick, 36, formerly of Burnham Intervale Road in Hopkinton, reached a plea deal with prosecutors Tuesday after being arrested about 16 months ago on attempted homicide and other charges.

On Dec. 27, 2021, she was involved in a knife-wielding home invasion where she threatened to kill her neighbors and their children. In March 2022, while in the Merrimack County Jail, she was arrested on attempted escape and assaults by prisoners charges, both felonies, accused of grabbing a corrections officer’s hands, grabbing at the officer’s keys, and pushing her through a door in an effort to escape from the Merrimack County House of Corrections in Boscawen. In another incident, she was also accused of stalking — texting, which violated a bail order.

On Tuesday, she reached a plea agreement on four of the charges. Herrick pleaded guilty to a single count of criminal threatening and received a 12-month sentence with pretrial credit of 365 days served in jail. She also pleaded guilty to the stalking charge and received another 12 months sentence, with 11 days credit, to run consecutive to the criminal threatening charge. Herrick also pleaded guilty to an assault by a prisoner and received a one-to-two-year prison sentence, suspended for five years, served consecutive to the previous two charges. She also pleaded guilty to a reckless conduct charge and received a two-to-four-year prison sentence, all suspended, for 10 years. That charge, too, would be served consecutively to all other charges.

Herrick must also refrain from having contact with the victims or their children.

Herrick will be on probation for three years when she is released from jail and must seek treatment after a counselor’s recommendation.
