Kenneth Smith, 63, of Mountain Road in Concord, was arrested at 5:43 p.m. on Aug. 15, on a DUI charge. According to a court affidavit, officers were sent to a motor-vehicle crash at the intersection of Shaker Road and Hoit Road. One driver reported to dispatch that another driver appeared to be intoxicated and was trying to leave the scene. The accident was minor – the vehicles only had scratches – and there were no injuries, the report noted. The driver and passenger of the other vehicle both accused Smith of rear-ending the vehicle they were in. They also accused him of "urinating in front of his car" and "not making any attempt to hide (his penis) which was clearly visible as he was urinating" by them. An officer spoke with Smith, who was sitting in a Mercedes with Florida plates with the vehicle still running and in drive mode, according to the report. Smith was asked to shut the vehicle off and is accused of fumbling with the shifter, trying to put the vehicle in park, and with the keys in the ignition, while trying to turn off the engine. When asked for his driver's license, Smith "pulled out several credit cards and business cards" before submitting his license, the report alleged. The officer accused Smith of having difficulty accessing his registration and slurring his words, the affidavit alleged. The officer also alleged that Smith smelled like alcohol, failed a field sobriety test, and when asked how much alcohol he had to drink, stated, "too much." Smith was accused of having a small cooler in the front passenger seat with six empty beer cans, the affidavit stated.
