Sentence in Peekskill's Park Street Slaying

The shooter had taken a plea deal last month.

PEEKSKILL, NY — Peekskill resident Janiel Myke was sentenced Tuesday to 15 years in state prison after having pleaded guilty to one count of First Degree Manslaughter in the shooting death of Stephen Agosto a year ago.

Myke, of 140 Rolling Valley Way, is 25.

At about 10:20 p.m. on Dec. 20, 2015, Myke shot Agosto three times with a stolen 9mm handgun. Peekskill police on patrol heard the shots and found the 22-year-old Hispanic man on the ground in front of 1431 Park St.

Agosto was taken to a local hospital where he was later pronounced dead. An autopsy conducted by the Medical Examiner’s Office revealed that the victim suffered a fatal bullet wound to the head and a bullet wound to each of his legs.

An intense police investigation resulted in Myke's arrest two days later.

Agosto and Myke had a long standing dispute, Acting Westchester County District Attorney James A. McCarty said in the announcement.

Myke was initially charged with second-degree murder. He pleaded guilty to the manslaughter charge in October. After sentencing Tuesday, Myke was handed over to the custody of the New York State Department of Corrections.

Assistant District Attorney Heide Mason of the Superior Court Trial Division prosecuted the case.
