Police Charge Stick-Wielding Man Wearing Just Underwear and Socks with Disorderly Conduct

Police said the North Kingstown man caused a bit of a disturbance when he became intoxicated on Sunday.

North Kingstown police charged a 28-year-old Updike Avenue man with disorderly conduct on Sunday after they responded to a noise complaint and he reportedly became aggressive with police officers in just his socks and underwear.

Police said they were dispatched to the area of Updike Avenue and Beach street at around 3:23 a.m. for the noise complaint and found Nicholas B. Hilbern, 28, of 45 Updike Ave., standing by a bonfire in his underwear and socks while holding a large stick.

“It appeared that all of the subjects were attempting to get Mr. Hilbern under control,” an officer said in a police report. “They were repeatedly telling him to be quiet.”

Several of Hilbern’s friends at the scene were cooperative with police said said that they all work together at a restaurant and came to Hilbern’s house after work. He reportedly was highly intoxicated and continued to drink, they said.

Hilbern then started swearing at the officer, telling him to get off his property.

Hilbern’s friends then tried to carry him inside the house as North Kingstown firefighters extinguished the bonfire, but Hilbern began fighting with his friends in an attempt to get back outside while swearing loudly.

By then, his friends told police that they didn’t feel all that interested in spending the night to take care of him and facing the prospect that he might be left alone, police attempted to place him into protective custody.

Hilburn continued to struggle with officers, told police to take off his handcuffs so he “could kick our asses,” police said, and even flipped over a stretcher as a rescue crew tried to get him transported to the hospital.

The combative behavior continued at the hospital and it led to doctors advising police that he would need to be sedated.

Police issued Hilbern a district court summons at the hospital and is due to appear in court at a later date.
