Undocumented Immigrant Charged With Illegal Re-Entry
ICE became aware the undocumented immigrant was in the U.S. when he was charged with assault and battery in Fairfax County.

(Updated 12:40 p.m. Thursday) FAIRFAX COUNTY, VA—An undocumented immigrant from El Salvador is charged with illegal re-entry into the U.S. after being removed twice, the U.S. Attorney for the Eastern District of Virginia and Immigration and Customs Enforcement announced Wednesday. The charge was brought before a judge in federal court.
ICE became aware of his presence in the U.S. when he was charged with with felony assault and battery on a police officer in Fairfax County during July 2016. He was convicted in February.
According to the indictment, Jose Amilcar De Leon Garcia, 44, was found in the U.S. in July 2016, without the consent of the U.S. government to reapply for immigration. De Leon Garcia faces up to two years in prison if convicted. ICE spokesperson Carissa Cutrell told Patch in an email, "Once court proceedings conclude and any corresponding prison sentences are served, the individual will be transferred to ICE custody and processed for removal."
