Suspect Arrested For Allegedly Shooting Man in Back of Head With Shotgun
The other man had walked away following a fight, according to police.

OAKLAND, CA — A man was arrested and charged with murder for shooting another man in the back of the head after a fight in East Oakland last week, prosecutors said.
Vick Malone, 64, of Oakland was arrested on Nov. 21 just after fatally shooting another man, Ernest Henry McMurry Jr. of Union City, outside his home in the 2300 block of 80th Avenue.
According to court documents filed by police investigators, Malone shot McMurry at 1:52 p.m. after the two men got into a fight outside. After Malone's neighbors separated them, Malone went into his house, came back with a shotgun, and shot McMurry in the back of the head as he walked away, police said.

Malone then re-racked the shotgun and pointed it at another man, who ran, according to police. Witnesses told police that Malone appeared to try and shoot the other man but the gun jammed.
Malone then went back inside. Police arrived a short time later and found McMurry suffering from the shotgun wound. He was pronounced dead at the scene, police said. Police arrested Malone when he came back outside. He still had the spent shotgun shell on him and when officers searched his home they found the
shotgun as well, according to police.

In addition to the murder charge, Malone has been charged with attempted murder for trying to shoot the other man. He remains in custody without bail and is scheduled to return to court on Dec. 15 for a plea
hearing, according to jail records.
