Concord Man Indicted On ‘Gut You End To End’ Threat Charge: Court

Gilford man indicted on youth detention rape allegations; Webster man indicted on burglary charge; Franklin woman accused of biting child.

CONCORD, NH — The following people were indicted recently in Merrimack County Superior Court.

Ashley Rodriguez-Shepard also known as “Phylix,” 24, of South Main Street in Franklin on a felony second-degree assault against a child under 13 and a domestic violence-simple assault charges. She was accused of biting a 5-year-old on the arm, leaving a mark, on April 29 in Franklin.

James T. Brown, 34, of Gooseberry Circle in Rochester on a felony delivery of articles prohibited charge. He was accused of being in possession of fentanyl while inside the Merrimack County House of Corrections in Boscawen on May 20.

Michael Digloria, 55, of Deerfield Road in Allenstown on a felon forgery charge. He was accused of making a retail installment contract against a GMC Sierra that he did not own on June 4, 2019, in Allenstown.

Victor Malavet, 59, of Gilford on seven aggravated felonious sexual assault charges. He was accused of raping a child in a youth detention services unit in Concord between June 1, and Nov. 30, 2001. Read more about this case here: 4 more former YDC counselors arrested in sex abuse investigation

Evan J. Sullivan, 21, of Elkins Street in Franklin on two conspiracy: reckless conduct and conspiracy: criminal threatening charges. He was accused of agreeing with two others to brandish guns and driving them to a home on Prospect Street in Franklin where they could fire the guns, believing another man was inside on May 17.

Nicholas Peno, 27, of Manchester Street in Concord on a felony criminal threatening charge. He was accused of sending a text message to a woman stating “I will hunt you down and gut you end to end” and that if she didn’t comply, the matter would end “with body bags” and she would “find out real quick what it felt like to be slaughtered life a f------- lamb,” or words to that effect on May 7 in Concord.

David M. Gales, 39, and Bridge Gales, 36, both of Canaan, Vermont, on a single felony count each of title fraud. They are both accused of using a false address for the application of titles on vehicles.

Eric Frazier, 40, of Concord, incarcerated at the time of the indictment, on delivery of articles to prisoners-tramadol and fentanyl mix and controlled drug act; acts prohibited-tramadol and fentanyl mix charges, both felonies, while inside the New Hampshire State Prison for Men in Concord on Sept. 11, 2020.

Robert J. Gaynor, 37, of Dustin Road in Webster on a felony burglary charge. He was accused of burglarizing the Bradford Market on Route 103 in Bradford on Oct. 18, 2020.

Cory Hendricks-Russo, 26, of Orr Road in Groton, Massachusetts, on a felony controlled drug act; acts prohibited-marijuana charge, in excess of 5 pounds, including any adulterants or dilutants, on March 31 in Contoocook.

Joshua Gabriel Desjardins, 37, of East Four Seasons Road in West Palm Beach, Florida, on a felony pistols & revolvers; convicted felons charge-brass knuckles on Dec. 11, 2020. Previously, according to the indictment, he was convicted on a felony theft charge in Merrimack County Superior Court in July 2013.
