Homeless Man Racks Up Theft, Robbery, Assault Charges
Concord Police arrest Dustin Averill after incidents in December at Staples, Best Buy, and Cumbies.

CONCORD, NH - A local homeless man was arrested last month and held without bail on numerous charges stemming from alleged incidents in December 2015, according to police.
Dustin P. Averill, 21, a homeless man now located in Concord, was arrested at 7:22 p.m. on Jan. 13, 2016, and charged with felony robbery, three counts of theft by unauthorized taking or transfer, and simple assault.

According to arrest reports and court affidavits, Averill was wanted on a number of warrants from incidents at area stores during the month of December. On Dec. 10, 2015, Averill allegedly committed a theft incident at Staples on Fort Eddy Road. A little more than a week later, he allegedly robbed the Best Buy on D’Amante Drive while also assaulting a teen at the store. On Dec. 21, 2015, police were also sent to the Cumberland Farms on Manchester Street for a report of a theft incident.
According to a court affidavit, two men walked into the store and then, quickly left the store. One of the subjects, who was wearing a dark puffy jacket, seemed to have something under his jacket since it was bulging in the front, the employee noted. She went and eyed video surveillance and alleged that the man in the dark jacket allegedly stole at least five cans of beer, valued at about $10, before exiting the store.

The reporting officer eyed the video and alleged that the man tucked numerous beer cans in his jacket, according to the affidavit. At the end of his shift, the officer shared the still photos and both a sergeant and a detective alleged it was Averill in the video stills.
“I checked the Concord Police Department records and located the most recent booking photographs of Dustin Averill,” the officer stated in a court affidavit. “I observed that the subject seen on the video surveillance footage appeared to match the booking photograph of Dustin Averill.”
The officer filed an affidavit on Jan. 7, 2016.
About a week later, officers were at the homeless shelter at St. Peter Church on an unrelated matter and spotted Averill standing in the foyer area. One of the officers ran a check and found the warrants for robber, assault, and theft, and arrested him. There was also a third warrant for Averill that was not yet active, according to the report, and he was held without bail.
During the last two years, Averill has been arrested numerous other times in Concord for nonappearance in court, assault, receiving stolen property, resisting arrest or detention, theft by deception, unlawful possession of alcohol, and simple assault against a cop.
