Nashua Felon Arrested On Burglary Charge In Hudson

Justin Spencer, who has been convicted of several crimes since 2007, faces new charges in Nashua and Hudson; has pending court cases, too.

NASHUA, NH — A Nashua man, with a slew of prior convictions and arrests based mostly around theft crimes, was arrested twice during the last 12 days, according to police.

On Nov. 13, a Nashua police officer took a report from a woman about a personal check that had been stolen and cashed for $1,500 on Nov. 6. The check was cashed at St. Mary's Bank in Nashua and was made out to "Justin Spencer," according to an affidavit. The victim denied writing the check and claimed not to know Spencer, according to a report.

On Dec. 8, the officer received surveillance pictures from the bank of the transaction and "positively identified" the man cashing the check as Justin Spencer, 33, of Nashua, "from prior police contacts."

On Sunday, police were contacted by a resident who reported a stolen backpack from a friend's vehicle.

The backpack included an iPhone, iPad, money, and other items. The victim used Find My Phone to track the iPad and iPhone and was standing outside of a Quincy Street residence where the victim had stopped tracking what he believed to be was his stolen iPhone.

An officer used the information from the phone which led him to Spring Street to Quincy Street — and to Spencer and another man, a report stated.

"While speaking with Justin, (the) officer noticed two cell phones in Justin's pants pocket," the affidavit stated. "Justin voluntarily removed the phones from his pocket and (the victim) positively identified the Apple iPhone as his and indicated this was the phone he was tracking. The tracking of the phone showed that it was in the exact location where they were standing."

Spencer was arrested and during a pat-down, an officer found money and checks, the affidavit said. During a consent search of a Quincy Street residence, the backpack was also found, the report stated. The friend of the victim reported that the checks were from his vehicle, the affidavit said.

A detective attempted a post-arrest interview with Spencer, "however, he refused to participate in the interview," the report said.

Spencer was charged with forgery and two counts of receiving stolen property, all felonies.

On Dec. 2, Spencer was arrested on a felony burglary charge in Hudson, according to police.

Officers were sent to Berkley Drive after a witness reported seeing an unknown man leaving a neighbor's house. The witness confronted the man, who identified himself as "Mike Bolton," and then, fled the area.

Police arrived as the witness pointed out the suspect, later identified as Spencer, and handcuffed him. An officer saw Spencer had a bloody hand and asked him about the injury. The report accused Spencer of saying he cut his hand while making dinner the night before.

Another officer spoke with the witness and then, checked out the home, and "observed forced entry had been made into the residence through a basement window," according to an affidavit. After speaking with the homeowner's daughter, who stated that no one was permitted in the home, Spencer was formally arrested and charged with burglary.

One officer searched the home and stated there were blood spots on door handles and surfaces in the home. The building was then cleared and Spencer processed and held on preventative detention.

Spencer is no stranger to police having been arrested and convicted of numerous crimes since 2007.

At the time of the Hudson arrest, Spencer was out on bail after being accused of burglary in Hudson in August 2017 and Nashua in May 2019, theft and credit card fraud charges from Nashua from November 2017, and theft by deception charges in Amherst from April 2019. Those cases are still open, according to superior court records. Spencer also has active violation of probation and parole accusations after being convicted on receiving stolen property and violation of probation or parole after a case in July 2016 in Nashua.

Between 2007 and today, Spencer has been convicted of theft by deception, theft by unauthorized taking, and receiving stolen property, all felonies.
