Fairfax DWI Arrest Leads To Illegal Reentry Indictment For Guatemala Native
A man detained in Fairfax County on a DWI charge was indicted on an illegal reentry charge, court records show.

ALEXANDRIA, VA — A man detained in Fairfax County after a DWI arrest has been indicted by a federal grand jury on an illegal reentry charge, according to court records.
Marvin Eleazar Len-Morales, also known as Franklin Len-Morales, was indicted June 11 in U.S. District Court for the Eastern District of Virginia on one count of illegal reentry after removal, a violation of Title 8, U.S. Code, Section 1326(a).
Len-Morales was found in the United States on or about Sept. 14, 2025, in Fairfax, Virginia, after previously being removed and deported on or about April 13, 2018, at or near Mesa, Arizona, according to the indictment. The indictment says he had not obtained permission from the U.S. attorney general or the secretary of the Department of Homeland Security to reapply for admission to the United States.

A federal affidavit filed in support of the criminal complaint said U.S. Immigration and Customs Enforcement learned that Len-Morales had been detained at the Fairfax County Adult Detention Center in Fairfax for driving while intoxicated, in violation of Virginia law.
The affidavit, signed by an ICE deportation officer, said record checks identified Len-Morales as a native and citizen of Guatemala who was last removed from the United States on April 13, 2018. The affidavit said Len-Morales did not have legal authorization to reenter or remain in the United States after that removal.

According to the affidavit, ICE obtained a fingerprint card and booking photo from Len-Morales’ Virginia arrest. The fingerprints were processed through ICE records and matched to Len-Morales, his immigration file and his FBI Universal Control Number, the affidavit said.

ICE’s Homeland Security Investigations Forensic Laboratory later compared fingerprints from Len-Morales’ 2018 removal paperwork with fingerprints taken Sept. 14, 2025, by the Fairfax City Police Department. The lab matched both sets of fingerprints to Len-Morales, according to the affidavit.
Court docket entries show Len-Morales was arrested May 15 and initially appeared that day before U.S. Magistrate Judge Lindsey R. Vaala in Alexandria. He was ordered temporarily detained, and a detention and preliminary hearing was set.
At a May 19 hearing before U.S. Magistrate Judge William E. Fitzpatrick, Len-Morales waived a preliminary hearing and did not contest detention at that time, according to the docket. He was remanded to U.S. Marshals Service custody without bond pending trial.
An arraignment for Len-Morales is scheduled for 10 a.m. June 18 in Courtroom 600 of the federal courthouse in Alexandria before U.S. District Judge Michael S. Nachmanoff, according to the docket.
An indictment is a formal accusation. Len-Morales is presumed innocent unless and until proven guilty.
