Banging on Apartment Doors Leads to Arrest of Previously Homeless Man

Concord Police charge Shelby Weston with disorderly, resisting, after he was warned to stop bothering others in the Crutchfield Building.

CONCORD, NH — An out-of-state man who was homeless this time last year, was arrested last month for allegedly disturbing neighbors in the Crutchfield Building on Pitman Street, according to arrest and court docs. Shelby E. Weston, 51, of Pitman Street in Concord, was arrested at 8:22 p.m. on Jan. 16, 2017, for disorderly conduct and resisting arrest or detention.

According to police, officers were sent to the building at around 7:30 p.m. for a report of a man yelling in the hallways. The officers visited with the man – Weston – as well as another man and they reportedly denied that they were yelling or being disorderly. The officers cleared the scene around 7:50 p.m., according to the affidavit.

Fifteen minutes later, they were sent back to the building and spoke with three neighbors who alleged that Weston was “out of control” and had been “pounding on all of their doors, yelling and swearing at them,” according to an affidavit.

One woman – who was the calling party – stated that dispatch could hear Weston allegedly screaming during the first call. She stated that she called police again after Weston began pounding on all the doors “accusing everyone of calling the police on him for being loud in his own apartment,” the report stated. When the woman told Weston to go back to his apartment, he allegedly told her to go “f--k” herself.

The officer went to speak to Weston again and alleged that he was “agitated and admitted to going out in the hall and pounding on his neighbor’s doors,” the report stated.

“Shelby began to get loud and then, started to scream at me,” the officer alleged.

The officer told Weston he was being arrested for disorderly conduct and he reportedly “just sat on his couch” and wouldn’t get up. He allegedly claimed he had a disability so the officers picked him up by the armpits to assist him but he allegedly began to resist. Weston was given another chance to comply, and he allegedly refused, so he was taken to the ground “in a controlled manner” so he could be cuffed.

Weston refused bail and was arraigned the next day.

In January 2016, Weston was homeless and at the time, was arrested on what appeared to be his 25th charge during the past five years. He has racked up charges for public drinking, panhandling, criminal trespass, theft by unauthorized taking or transfer, bail jumping, default or breach of bail conditions, and numerous warrants for not showing up to court appearances.

Back in 2009, Weston and another man – Leon VanTrees – both homeless at the time, were arrested for allegedly kicking to death Kevin Russ Woodruff, another homeless man in Tulsa, OK. The charges were later dropped after a witness died and another disappeared. Prosecutors reported at the time that charges could be refilled against the pair if more evidence developed in the case.
