Man Arrested For Trying To Beat Concord Cop With A Belt: Report

Nyabunguye Tembasi was arrested recently for reportedly breaching bail. While in a cell at HQ, he allegedly attempted to assault an officer.

CONCORD, NH — A local refugee, with a long record of crime in Concord, was arrested again earlier this month after he allegedly tried to assault a police officer. Nyabunguye Tembasi, 24, currently homeless, with a last known address of Fisherville Road in Concord, was arrested on Nov. 21, 2017, and charged with default or breach of bail conditions and attempt to commit-simple assault on a police officer. Last Tuesday morning, at just before 12:30 a.m., an officer was driving north on North State Street when he was flagged down by an individual near the Blossom Hill Cemetery.

The officer pulled into the cemetery and asked the man how he could help. While doing so, the individual walked over to the officer, lost his balance, and stumbled forward, according to a court affidavit. The man requested a ride from the officer to his home, the report noted. The officer alleged that the man smelled like alcohol and asked him how much he had to drink. He allegedly replied, “No drink.”

The officer reported that the man had bloodshot, glassy eyes, and asked the man to sit on the curb, so he wouldn't fall again. He reportedly checked his non-driver identification and realized it was Tembasi.

“Through my interactions with other officers, I know that Tembasi is frequently arrested,” the report stated.

The officer checked with dispatch and they stated that Tembasi was out on bail from Oct. 21, for prowling and attempt to commit theft, and was to refrain from drinking, the affidavit stated. The officer eyed Tembasi’s criminal history and found charges from early August to late October that did not have dispositions. The other charges included two counts of criminal mischief, domestic violence, simple assault, attempt to commit, and loitering and prowling. Tembasi, who is originally from the Congo, has been arrested about 20 times since 2012 and is trespassed from a number of properties, including the Concord Public Library and Concord Housing Authority properties, according to reports.

Tembasi was requested to take a portable breath test, allegedly blew a 0.16, and was arrested.

At police headquarters, while in a holding cell, Tembasi told the officer that he had to relieve himself and was asked to take off his belt and shoes first. After being asked for his belt, Tembasis allegedly stated, “I want to slap you in the face,” the affidavit noted.

Tembasi stared at me (and) rapidly took off his belt,” the officer alleged. “Once Temasi’s belt was off, he whipped it towards my face. I brought my head back so the belt would not hit me in the face. Had I not brought my head back, the belt would have struck me in the face.”

The officer noted that after hundreds of arrests and booking processes, this was not a normal handing over of property situation and, at no point, did he feel that Tembasi was just handing over or tossing his belt to the officer, the report noted. Due to his alleged intoxication and “aggressive and uncooperative behavior,” he was put back in handcuffs, transported to the Merrimack County House of Corrections, and scheduled to be arraigned later that day.

Charges against Tembasi since 2012 – along with the aforementioned charges – include numerous simple assault, criminal mischief, and criminal trespass charges as well as domestic violence, criminal threatening, loitering, violation of privacy, theft by unauthorized taking or transfer, operating without a valid license, resisting arrest or detention, and a number of default or breach of bail conditions charges.
