Police Log: Man Charged with DWI After Passing Out in the Mickey D's Drive-Thru Lane

Plus, Concord man allegedly smashes his girlfriend's car's windshield and a Franklin woman returns to Concord to panhandle.

James Edward Moscaritolo, 41, of Broadway in Concord, was arrested at 12:10 p.m. on Sept. 11, on possession of controlled drugs and theft of lost or mislaid property from June 24, at the Cash for Gold on Manchester Street. While parked near Humphrey Street, an officer saw Moscaritolo and ran a check on him, found out that he had an active warrant, and arrested him. He later admitted to having a marijuana pipe and a baggie of marijuana in his pockets and was charged.

Stephanie Joyce Dupont, 30, of North State Street in Concord, was arrested at 12:45 p.m. on Sept. 11, with felony theft, due to two previous convictions, and possession of prescription drugs without a prescription. Officers called to TJMaxx for a report of a shoplifter in custody. Employees alleged that Dupont stole several items of clothing, removed the tags, and concealed them in her purse. During a pat down, an officer allegedly found one tablet of Concerta. On Aug. 4, she was convicted of two counts of theft by unauthorized taking in Concord District Court so the charge was elevated to a felony. She was on parole at the time of the arrest, according to the report.

Elizabeth Christina Martin, 27, of Electric Avenue in Concord, was arrested at 12:50 p.m. on Sept. 11, on a bench warrant. While at the TJMaxx arrest, an officer made contact with Martin and found out that she had an active warrant out of Concord District Court from Sept. 5, $1,000 cash to settle. She was arrested and sent to the Merrimack County House of Corrections.

Suresh Rai, 43, of Jennings Drive in Concord, was arrested at 8:52 p.m. on Sept. 11, on two counts of driving while intoxicated, aggravated driving while intoxicated, and a lane control violation. While on patrol on North State Street an officer saw a Nissan sedan having lane control issues. The car was weaving back and forth in the south lane. The vehicle was pulled over near the Hood Plant. The driver, Rai, allegedly had droop, glassy, and bloodshot eyes, and smelled like alcohol. After reportedly apologizing numerous times for weaving all over the road, he agreed to field sobriety tests, and was arrested.

Brandon E. Haines, 37, of Danbury Road in Center Barnstead, was arrested at 1:43 a.m. on Sept. 12, on two counts of driving while intoxicated and aggravated driving while intoxicated. Concord Fire and Rescue teams as well as an officer were called to the McDonald’s Restaurant on Loudon Road for a report of a person passed out in a Dodge Caliber in the restaurant’s drive-thru lane. The man’s chin was on his chest but he was breathing. An officer reported that there was a Bud Light beer can in a bag on the front seat. The officer spoke to the driver, who allegedly gave off a strong odor of alcohol, and also tapped on his shoulder but couldn’t wake him up. He later work up and reportedly told the officer he was tired from working and fell asleep in the drive-thru lane. Haines agreed to perform field sobriety tests and was arrested.

Amber N. Nishikawa, 28, of Washington Court in Concord, was arrested at 1:51 a.m. on Sept. 12, on a driving while intoxicated charge. While on North Main Street, an officer saw a woman stumbling toward the Durgin Block Parking Garage. The officer drove around the area a number of times but couldn’t find the woman. Then, the officer saw a Toyota Yaris take a turn onto North State Street from School. The vehicle had “severe problems with its lane control” and was weaving so the officer pulled it over at Centre Street. The driver, Nishikawa, matched the description of the woman who was reportedly stumbling while walking to the garage. Nishikawa’s fingers allegedly slipped of the registration three times, she was slurring her words, and her eyes were red. She agreed to a field sobriety test and was arrested.

Nina Merchant, 37, of South Main Street in Franklin, received a summons at 11:33 a.m. on Sept. 12, for passing of items to or from the occupant of a motor vehicle. An officer reportedly saw Merchant leave the sidewalk near the L.L. Bean, walk into the street, and take money from a vehicle. When the officer approached, Merchant reportedly began to walk away and stated, “I’m done, I’m leaving, now I have been warned.” When asked to stop, she did, but then, told the officer she wouldn’t do it again and tried to walk away. “Merchant became increasingly agitated as we spoke and was very rude,” the officer alleged. She was then given the summons.

Michael Alan Mobbs, 35, of Washington Street in Concord, was arrested at 3:54 p.m. on Sept. 12, on a criminal mischief charge. Bianca Desiree Berryman, 22, of Washington Street in Concord, received a summons at 4 p.m. on Sept. 12, on a criminal mischief. Officers were sent to an apartment on Washington Street for a domestic disturbance. Mobbs reported told officer that he and Berryman had an argument and she reportedly broke his Xbox by pulling the CD part of the unit. When speaking with Berryman, she reportedly stated that Mobbs came home from work and they just started arguing and she didn’t even know why. She alleged that he threw several Concord Public Library DVDs at a bedroom door, breaking the cases. Berryman then allegedly started throwing the kids’ toys around and then broke the Xbox.

Annie B. Turner, 34, of Pinehurst Street in Penacook, was arrested at 7:45 p.m. on Sept. 12, on a bench warrant. An officer was sent to Pinehurst Street for a report of two kids who were fighting in a hallway and one broke a plate. Turner reportedly told the officer that they were dealing with the issue as parents and the officer cleared the call. However, later, a check of Turner revealed a warrant for operating after suspension, $315 cash to settle, from July 29, and she was arrested.

Chad McAlpine, 29, of Fisherville Road in Concord, was arrested at 11:06 p.m. on Sept. 12, and charged with criminal mischief and resisting arrest or detention. Police were called to a domestic disturbance on Fisherville Road with a woman alleging that her boyfriend smashed the windshield to her car. A detective and an officer spoke to the woman and her mother. The woman was visibly upset and crying. She stated that the two got into an argument after he didn’t know where she was and he allegedly smashed her windshield with a beer bottle. The detective placed McAlpine under arrest and he was allegedly intoxicated, slurring his words, and repeating questions that had already been answered. He allegedly began yelling and swearing, and refused to walk to the police cruiser. He’s due in court on Oct. 27.

Stephanie Rossi, 29, of Fisherville Road in Concord, was arrested at 1:28 p.m. on Sept. 13, on a bench warrant from the Concord Police.

Francine Barron, 40, of Thorndike Street in Concord, was arrested at 3:20 p.m. on Sept. 14, on two theft by unauthorized taking or transfer from Aug. 25, at the Dunkin’ Donuts on South Main Street. Barron was out on parole so her probation officer was notified. She’s due in court on Oct. 27.
