Concord, Seabrook Men Arrested on DVO Violations: Police Log

Mass. man charged with DWI, Boscawen man arrested on driving charge, a homeless man was arrested for allegedly trespassing at McDonald's.

CONCORD, NH — Adam M. Babineau, year of birth 1982, of Tanner Street in Concord, was arrested at 6:45 a.m. on April 3, 2017, for violation of a protective order. During the early morning hours of Nov. 6, 2016, officers took a report of a possible DVO violation from a woman who was getting “unknown” calls and believed it was Babineau, due to recognizing his voice, according to an affidavit. They checked the order and confirmed that Babineau had specific rules he could reportedly use to contact the woman. The woman reportedly stated that she picked up the calls but wouldn’t speak and then, would hang up. After a few calls, she answered another one, made a comment about family and other issues, and allegedly heard Babineau state, “F--- you,” and then, hang up the phone. The reporting officer noted that there had been 22 calls during a 48-minute time period, according to the affidavit. The woman agreed to consent to have her cellphone carrier release her records to police, which she did on Nov. 9, 2016. The officer also called Babineau but he allegedly denied all knowledge of the calls. He reportedly did not grant access to his cellphone records, the affidavit stated. On March 21, the officer received the phone records from the cellphone provider which indicated that the unknown calls had allegedly come from Babineau’s phone, the April 2, affidavit noted.

Michael A. Arsenault, YOB 1987, of School Street in Concord, was arrested at 10:45 a.m. on April 5, 2017, on a warrant. He was arrested after an alleged incident in the Gully Hill area of Loudon Road.

Patrick S. Walsh, YOB 1959, a homeless man now located in Concord, was arrested at 12:14 a.m. on April 6, 2017, for criminal trespass. Officers were sent to the McDonald’s Restaurant on South Main Street for a trespass call involving Walsh, who was allegedly in the restaurant’s lobby in violation of an order. The letter was served to Walsh on March 29, according to the report. The officers allegedly found Walsh in the bathroom washing his hands and he claimed that he didn’t know he had been trespassed from the property. The officers confirmed the notice and arrested him. During processing, bail was set at $100 cash and Walsh allegedly became belligerent with the bail commissioner, yelling profanities, until she left the room. Walsh was held and arraigned the next day.

Ian M. Decato, YOB 1997, of Main Street in Boscawen, was arrested at 7:32 p.m. on April 6, 2017, for driving after revocation or suspension. The arrest was made north of the Contoocook River near Hanna Dustin.

Michael Depont, YOB 1982, of Scott Avenue in Seabrook, was arrested at 1:57 p.m. on April 8, 2017, for domestic violence-violation of a protective order. On April 7, an officer was sent to Rex Drive to investigate a possible DVO violation. A woman alleged that a 30-day order had been served to Depont the day before and at around 6 p.m., one of his relatives showed up at the home to pick up some of his things. The order, however, did not allow for third party contact, and relative later left. The relative then went to police and requested a civil standby but the woman was unable to schedule that, the affidavit noted. The officer called the relative who allegedly stated that she and Depont were in the area and since he needed his clothes and tools, she drove over to get them. She reportedly stated that he waited a distance away from the home but when the victim couldn’t accommodate her getting his items, she went to police headquarters to arrange a standby, the affidavit stated. She reportedly stated she was unaware that the DVO didn’t allow third-party contact. The reporting officer spoke to Depont and he allegedly stated that Seabrook Police didn’t explain the third-party contact issue to him and he misunderstood what it meant, thinking it meant he could not use his relative’s phone or email or someone else’s means to contact the woman.

Steven B. Johnson, YOB 1954, of Tiller Drive in East Falmouth, MA, was arrested at 10:26 p.m. on April 8, 2017, for driving while intoxicated and driving after revocation or suspension. He was arrested after an alleged incident on South Main Street.
