Gavin R. Guay, 25, of Pleasant Street in Concord, was arrested at 10:13 a.m. on Dec. 27, 2016, for domestic violence-violation of protective order and two bench warrants. One of the warrants stemmed from an alleged incident on Celtic Street. On Dec. 26, according to a court affidavit, officers were sent to Pleasant Street for a report of a suspicious vehicle and men at a vacant house. The tipster knew that the house was vacant but saw “an unfamiliar vehicle in the driveway with a male subject going in and out of the garage,” according to the affidavit. The caller stated that they thought the suspect might be Guay and that he had an active restraining order by the owner of the house. Police arrived but the vehicle and man were gone. They saw no forced entry but fresh footprints in the snow. The reporting officer spoke to the tipster who alleged that they saw something skinny – like a ladder or skies – being taken out of the garage by a passenger of the vehicle. The witness then reportedly positively identified the passenger with the item as Guay, according to the affidavit. An officer contacted the owner of the home who confirmed the restraining order and that Guay had allegedly called her in an effort to line up a civil standby to get the skis. Since she was unavailable, she couldn’t accommodate the request. “That’s probably what it is,” she told the officer. She also gave the officers a possible name of the second person. The reporting officer checked the restraining order and confirmed that it stated that Guay was not to enter the premises, according to the report. The officer then called Guay and, according to the affidavit, he first reportedly denied being at the home but then, allegedly changed his story after being told there was a witness. Guay was given the option of telling the officer where he was so he could be arrested or turn himself in and he chose to be arrested the next day. Guay has previously been arrested for probation violations, reckless conduct, criminal mischief, nonappearance in court, and driving charges. He was indicted for receiving stolen property last year.
