Adolphe Ndayishimiye, 21, of Loudon Road in Concord, was arrested at 12:30 a.m. on July 23 on breach of bail and resisting arrest or detention charges. Police were sent to the Royal Gardens apartment complex for a disturbance involving as many as a dozen people in a parking lot. People were “yelling or possibly dancing or fighting,” the caller stated. As officers arrived, the group of mostly young men began walking or running from the area. An officer approached Ndayishimiye, who was “sweating profusely as if he had been involved in physical activity,” an arrest report stated. Ndayishimiye questioned why the officers were there and claimed there was no fight, an affidavit stated. The reporting officer accused him of smelling like alcohol and admitting to drinking. When asked how much, Ndayishimiye said, “A lot, so f--- you, man,” an affidavit stated. Ndayishimiye was accused of slurring his speech, having glassy and red eyes, and having trouble walking. The officer said he began to pick up bottles and staggered while doing so, the report said. The officers told him to stop and that they would pick up the bottles but Ndayishimiye refused and began to walk “very fast” away from police and they attempted to stop him, an affidavit said. Ndayishimiye was accused of pulling away from the officers and arguing so the officer pulled out a Taser and ordered him to stop. Ndayishimiye stopped and dropped the bottle, the report said. The officers attempted to take him into protective custody due to intoxication but he pulled away from officers and refused to be cuffed, the affidavit stated. Three young girls then came to Ndayishimiye’s aid, stating they would take custody of him but when asked for their names, they refused to give them to police, according to the report. The officers continued to handcuff Ndayishimiye as the girls began yelling at the officers and recording their actions. “They began to yell at us and project their disdain of our profession and us,” the officer wrote. Ndayishimiye was placed in a cruiser and accused of “kicking the inside of the patrol car” as tenants began exiting their apartments to find out what was going on. At police headquarters, a check found that Ndayishimiye was out on bail and ordered not to drink, the officer wrote, and he was charged and held.
