Casey L. Fleming, 19, of Manchester Street in Concord was arrested at 1:31 a.m. on June 22 on unlawful possession/intoxication and resisting arrest or detention charges. Officers and a sergeant were sent to Manchester Street on a check the welfare call after reports of screaming from the apartment building. When they arrived, they found a woman standing over Fleming who was "passed out" on the ground and unresponsive, according to an affidavit. Eventually, the affidavit stated, he woke up, spoke with slurred words, and had glassy eyes, but refused to acknowledge the officer. Later, the affidavit said, Fleming became "hostile" toward the officers when they attempted to speak with him and officers made the decision to take him into protective custody and charged for being intoxicated and not of age. An officer gave Fleming his shoes, requested he put them on, but he was accused of refusing and kicking them away. Officers attempted to pick him up and he was accused of tensing up his arm, attempting to pull away, and refusing to stand up, the report said. Later, "Casey let his body go completely limp, and in order to place him in custody, (the officers) guided him to the ground in a controlled manner" to cuff him. The officer accused Fleming of "belligerent behavior, spitting, yelling, swearing, and banging his head on the partitions of the cruiser" and he was taken straight to county.
