Michael J. Depont, 41, a homeless man now located in Concord, was arrested at 3:30 p.m. on Aug. 4 on a felony possession of a controlled drug charge and a warrant. Officers were sent to Storrs Street for a report of a suspicious person — with an unknown caller reporting two men trying to break into a black Chrysler. “The caller confronted the males and they stated that their mother lost the keys and they are trying to fix the alternator,” an affidavit said. When the reporting officer arrived, they found two men in front of a GMC Terrain, focusing on the vehicle's hood. The officer drove around the area looking for a Chrysler, while confirming with dispatch the make and model of the vehicle. The reporting officer returned to the vehicle, ran the plate, and spoke to a man the officer recognized, who was the son of the owner of the vehicle. The officer also knew the owner and had interacted with her recently. The officer noted in the report, “Almost immediately after arriving on scene, my suspicion of any crime occurring had been dispelled.” The officer spoke to the second man, Depont, who was accused of walking away from the officer. The officer ran a check on Depont and found he had an active “no bail” warrant for failing to appear on a felony drug charge in Merrimack County Superior Court on June 28. The officer drove over to speak with Depont near Storrs and Pleasant streets, informed him of the warrant, and arrested him. During a search, Depont was accused of having a metal spoon in his backpack as well as three clear baggies, one that contained an off-white, tan-colored powder, believed to be fentanyl, an affidavit stated.
