Maury John Madeiros, 37, of Dover Road in Epsom, was arrested at 9:32 p.m. on April 25 on driving under the influence and DUI-second offense charges. An officer on Loudon Road saw a Volvo S80 with its hazard lights on, blocking traffic on the westbound side, in the right left-hand turn lane of the Interstate 93 onramp. The officer turned around to investigate and accused the driver of having his head down. The driver, Madeiros, rolled down the vehicle window and told the officer he had run out of gas and that a friend was on his way to help him, according to an affidavit. The officer said there was a 12-pack of Sun Cruiser in the backseat, which was opened, and the keys were in the ignition, but the engine was off. Other officers arrived at the scene to assist. When asked if he had been drinking, Madeiros said he had not, an affidavit said. Madeiros agreed to take a field sobriety test but “became upset with me and did not know why I was asking him to step outside his vehicle because he ran out of gas,” the officer wrote. After exiting the vehicle, the officer accused the driver of smelling of alcohol. Madeiros was asked repeatedly if he would be willing to take a field sobriety test or breathalyzer, and he said he was not, the affidavit said, with the officer noting he was “swaying back and forth” while talking to him. Madeiros was then arrested, taken to headquarters, but later, deemed uncooperative by a lieutenant, and was taken to county, an affidavit said. On the ride to jail, Madeiros was accused of “slurring his words” and giving off an “extremely strong” odor of alcohol. According to the officer, he was convicted of DUI in May 2024 in Concord District Court.
