Because those reports quote them extensively, and they have routinely declined the offer. But who knows, maybe this time will be different.

The affordable housing crisis can't be solved without affordable housing that doesn't require federal subsidies.

To be clear, this writer is NOT suggesting that subsidies simply be halted. Many real people who had little or nothing to do with this currently rigged system would be hurt if that happened. That said, by enforcing existing federal laws on a consistent basis, the affordable housing crisis could be solved and in the foreseeable future. The need for subsidies would fade naturally. Homelessness would fade naturally because much of homelessness is caused by a lack of affordable housing. HUD researchers Regina Gray and Pamela Blumenthal effectively said that 50 years of housing policies have not solved the affordable housing crisis.

It is time to do things differently.

After twelve years of discussion and study, Congress passed in a widely bipartisan way the Manufactured Housing Improvement Act of 2000 (a.k.a.: MHIA, MHIA 2000, 2000 Reform Law, 2000 Reform Act). Then President William Jefferson "Bill" Clinton signed it into law. It included a provision to overcome local zoning and placement barriers known in industry circles as "enhanced preemption." Without using federal preemption, 50 years of evidence (see linked reports) clearly suggests that nothing meaningful will change.

The problem is that several MHI members have openly said that their business model is based on the status of NIMBYism and limiting development. Here is how Equity LifeStyle Properties (ELS), Sun Communities (SUI), and Flagship Communities (TSE: MHC.U) - all prominent MHI board members - put it in their own investor relations (IR) presentations.

Sun said below: "Virtually no new supply [of land lease manufactured home communities or MHCs] has been added for years" as part of a "Compelling Supply-Demand Fundamentals." ELS said above: "Supply Constrained Asset Class" and that "Growing demand coupled with almost no new supply is a strategic advantage for ELS."

ELS also said the reason for the "Supply Constraint" is NIMBY (Not in my back yard), "Restricted zoning and regulations" and "Federal Planning vs. local planning."

This isn't speculation, it is quoting their own words and putting it into perspective with other known facts.

Yet in an IRS Form 990 filed under penalities of perjury, MHI said the following. Here is what that Summary said: “Improve the overall operating environment for the manufactured housing industry and expand the demand for manufactured homes by seeking fair and equitable treatment in the marketplace and the regulatory and legislative arenas.”

If Schmitz and his colleagues are correct, and there is no known serious public challenges to their remarks (there was nothing posted on the NAHB or Eye on Housing websites)

Under federal law, collusion to violate the law extends the time before statutes of limitations run.

Public officials need to act.

Affordable housing advocacy groups that are sincere in their desires to serve millions should take up this mantle and press for it, as MHARR has done for years.
