Concord Felon Accused Of Trespass, Possessing Fentanyl And Stolen License

CONCORD, NH — A felon with active cases in superior court finds himself in more trouble with police after an incident at Royal Gardens earlier this month.
Officers on foot patrol in the area of the complex around 8 p.m. on May 3 decided to check in on a woman involved in a recent incident and make sure Nathaniel Joseph Bergeron, 27, her accused abuser, “was not staying with her,” an affidavit said. When police arrived at the apartment, a man reportedly fled out a back door of the apartment.
The officers split up in an effort to capture the man, a report said. The reporting officer “stood flush with the building several apartments (away)” and, after a few minutes, saw a man emerge. The man saw the officer and “started to run” toward East Side Drive. The man was ordered to stop but refused, the report stated.

The man ran toward Loudon Road, attempting to enter one of the other apartments, but was unsuccessful. The officer unholstered their Taser and pointed it at the man, ordering him to the ground. When he obliged, the officer holstered the device, the report said.
The second officer arrived, and the man, later identified as Bergeron, claimed he was having an asthma attack, so Concord fire and rescue teams were requested. The officers placed him on his side so he could recover, the report stated. Bergeron said he used “a lot of fentanyl” and began to puke, an affidavit stated. The reporting officer wrote Bergeron began nodding off before EMTs arrived.

While being treated, dispatch told officers Bergeron had a no-bail county warrant for failure to appear, and he was taken to Concord Hospital.
The reporting officer spoke to a tenant of the complex who accused Bergeron of attempting to gain access to her apartment during the incident.
At the hospital later, the reporting officer searched Bergeron’s possessions and accused him of having a kit, several straws, a capped needle, a scale, and a small baggie of a tan, powdery substance believed to be fentanyl. Inside his wallet was a driver’s license owned by a 27-year-old woman, the report stated. The officer called the woman and asked if she knew Bergeron, but she said she did not. The woman “seemed confused” by the situation and why Bergeron was accused of possessing her license. When asked if she wanted a theft charge pursued, she said she did, the officer wrote.
Bergeron was arrested and charged with felony drug possession, receiving stolen property-less than $1,000, criminal trespass, and resisting arrest or detention.
According to superior court records, Bergeron’s criminal history dates back about a decade and includes about two dozen cases in Concord and the capital region, as well as the Lakes Region. Bergeron has been convicted of assault, drug possession, forgery, reckless conduct-deadly weapon, and other charges.
In 2023, he faced 11 different cases in Merrimack County Superior Court, including multiple counts of theft, habitual offender, receiving stolen property, and acts prohibited.
One case, a violation of probation charge after pleading guilty to theft and habitual offender out of Concord in December 2023, is still active.
Bergeron also has an active receiving stolen property charge, a felony due to two prior convictions, out of Concord from February, which was boundover to Merrimack County Superior Court. He is due for a dispositional conference hearing on May 29.
