Devyn Michael Merrill, 23, of North Main Street in Concord was arrested at 4:30 p.m. on Jan. 24 on felony operate after certification as a habitual offender as well as driving after suspension and driving after suspension-subsequent charges. An officer in the parking lot of Walmart on Loudon Road saw a Kia Optima in the parking lot driving toward them, and the driver, a man with a beard, “appeared startled” when seeing the officer. The car went to another part of the parking lot and the officer ran the plate. The car was owned by a woman, but Merrill was connected to her, according to police data. The report said the officer knew Merrill from previous contacts and knew he had a suspended license. The officer drove over to the car and spoke with Merrill — who was now wearing a hat and a hood, the officer claimed. The officer asked Merrill why he was driving, since he had a suspended license, and he shrugged, the report said. “We just got out,” the officer claimed he stated but did not ask him to elaborate. Merrill, dispatch said, had a bench warrant for aggravated driving under the influence with $1,000 cash to settle and was arrested. The officer noted he was certified as a habitual offender in November 2022, and his license was suspended in March 2019 due to a drunken driving conviction. Along with that conviction, during the past five years, Merrill has been found guilty of driving after revocation in Concord District Court in August 2021 and aggravated driving while intoxicated in Franklin District Court in July 2022. He was released on bail on Feb. 3 and is due back in superior court on May 15.
