Instead, MHI has focused on promoting CrossMod™ homes, a niche product that has failed to gain traction. Meanwhile, key federal laws designed to support manufactured housing—such as the Manufactured Housing Improvement Act of 2000 (MHIA 2000) and the Duty to Serve (DTS) mandate under the Housing and Economic Recovery Act of 2008—remain largely unenforced.

The Manufactured Housing Association for Regulatory Reform (MHARR) has repeatedly called for enforcement of these laws, arguing that doing so would unlock significant growth in the sector. But MHI, which claims to represent “all segments” of the industry, has been silent or evasive on these issues. In fact, former MHI chairman Tim Williams of 21st Mortgage once said that pursuing DTS was a “complete waste of time”—a statement that directly contradicts the law’s intent.

The Role of Antitrust

This is where antitrust comes in. The manufactured housing industry is a textbook case of vertical integration and market concentration. A few dominant players control production, financing, and distribution. Independent retailers and producers have been squeezed out. Zoning barriers and financing restrictions—issues that federal law was meant to address—persist, in part because the dominant firms benefit from limited competition.

James Schmitz Jr. and his colleagues have described this as a form of “sabotage monopoly,” where powerful interests use regulation and market manipulation to suppress competition. In manufactured housing, this has taken the form of:

  • Blocking enforcement of enhanced preemption under MHIA 2000
  • Undermining DTS implementation for personal property (chattel) loans
  • Promoting niche products like CrossMod™ while ignoring mainstream HUD Code homes
  • Failing to launch a serious national image campaign, despite decades of promises

These tactics don’t just harm competitors—they harm consumers, especially low- and moderate-income families who are priced out of homeownership.

Left–Right Convergence

What makes this issue so compelling is that it transcends partisan lines. Matt Stoller, a progressive antitrust advocate, and Steve Moore, a conservative economist and former Trump adviser, both recognize the dangers of market concentration. In a recent Daily Signal column, Moore criticized the DOJ’s antitrust challenge to the HPE–Juniper merger, arguing that it undermines U.S. competitiveness against China. While Moore and Stoller may disagree on specific cases, they both understand that monopolies distort markets and harm innovation.

In the case of manufactured housing, the distortion is clear: a federally regulated, factory-built housing option that should be thriving during an affordable housing crisis is instead languishing—because the system is rigged.

A Call for Accountability

It’s time for antitrust advocates like Matt Stoller to connect the dots. The manufactured housing sector is not just another niche—it’s a critical piece of the affordable housing puzzle. And the evidence of monopolistic behavior is not speculative; it’s documented in court filings, federal reports, and industry statements.

Stoller has the platform, the credibility, and the tools to shine a light on this issue. So far, he hasn’t. But the door remains open.

As for policymakers, journalists, and advocates across the spectrum: if we’re serious about solving the affordable housing crisis, we need to look beyond the usual suspects. That means scrutinizing not just Zillow and Rocket Mortgage, but also Clayton Homes, Berkshire Hathaway, and the Manufactured Housing Institute.

Because when the most affordable form of homeownership in America is being quietly sidelined by the very firms that claim to support it, that’s not just a policy failure—it’s a moral one.
