John Robert Sweeney, 55, of North State Street in Concord was arrested at 4:48 p.m. on March 3 on a felony controlled drug act; acts prohibited- charge. Officers were sent to the Speedway on North State Street for a report of a theft. Dispatch said an employee at the store claimed a white man, about 5 feet, 10 inches tall, stole a beer, and then walked toward the Concord Homeless Resource Center. An officer found a man matching the description and asked if he was at the store. According to an affidavit, the man said he was there and bought some cigarettes. When told he matched the description of a man reportedly involved in a theft incident, he “began dumping out his backpack and told me that he wouldn’t steal because he is incarcerated and lives at the halfway house on North State Street,” the officer wrote. The man, ID’d as Sweeney, had an active superior court warrant for failure to appear on a felony drug possession charge in January, and he was arrested. During a search of the backpack, the officer found a toothbrush container with a loaded syringe inside, a report said. Sweeney was accused of claiming it was testosterone. The officer said other pre-workout materials were in his backpack — including bottles of water, caffeine pills, and powdered mix but noted testosterone was a controlled substance and Sweeney did not have a prescription for it on him, the affidavit said.
