ROAD to Housing Act 2025: Real Reform or Reinforcement of the Status Quo? Could it Make Housing Fix Harder?

ROAD to Housing Act of 2025 is hailed by several housing nonprofits, but the bipartisan bill reflects serious disconnect with existing law.

The affordable housing crisis is both simple and complex. Simply put, there are not enough inherently affordable homes being built to keep up with demand.

The National Association of Home Builders (NAHB) has acknowledged that fact for years.

So, what the federal government (and sometimes state and local governments too) have done for decades is to provide subsidies for builders, developers, and housing providers.

But what that means is taxpayers are paying for that increased 'affordability.'

For 50 years, per the U.S. Department of Housing and Urban Development (HUD) own researchers, that approach of failing to fix the zoning and regulatory barriers that are near the heart of the affordability crisis has not worked. Politicians in both major parties have promised, said HUD researchers, to fix it. But they have never delivered.

HUD said so.

With that brief backdrop, that begs the question. Will the ROAD to Housing Act 2025 be any different?

The short answer? As the bill stands now, no.

There may be lots of hype. But a careful reading of the lingo in the law, past experience, and other factors found here, little may change and that may take years.

For reasons unpacked in detail in the full evidence-backed MHProNews analysis here, many of the trade groups involved in this picture are backing a bill that could make the status quo worse.

The fix?

There are existing laws Congress passed some 17 and 25 years ago that this ROAD to Housing Act of 2025, and other housing legislation in the U.S. House, does not mention. Those laws have not been properly implemented.

A useful analogy is U.S. border and immigration laws.

The same laws existed under Joe Biden-Kamala Harris (D) leadership a year ago as exists now under President Donald J. Trump (R) and Vice President J.D. Vance (R). The southern border is closed today. A year ago, tens of thousands of migrants were crossing our borders illegally every month. The difference? It can be summed up in one three words. Enforce existing laws.

That is what is needed with the various housing efforts too. Existing laws that are already on the books need to be robustly enforced.

The various pending bills, including the ROAD to Housing Act, are all but guaranteed not to work. Who says? Various third-party artificial intelligence (AI) fact checks that are provided in the report linked here. There are human experts who see the same problems that AI sees.

Perhaps some of those lawmakers have good intentions. But millions know the old saying about the road to hell is paved with good intentions.

Meanwhile there are special interests that do not want to see the affordable housing crisis solved because they believe they are profiting from the status quo. We spotlighted that in a Patch post approaching a year ago (8.29.2024) that is linked below. Those insights remains true today.

Perhaps it is a coincidence.

But the ROAD to Housing Act 2025 demonstrably won't change the status quo. At its best, the bill would take years to kick in. It may, per sources, improve some things at the margins, but only years from now.

It would be faster, more logical, and less costly to enforce good existing laws.

That should happen before enacting new legislation that is all but guaranteed to fail or make only a modest difference, as the ROAD to Housing Act stands today.

The choice facing Americans could be boiled down to this. We can see more tents, cars, cardboard boxes, people sleeping under bridges, on sidewalks or in old metal RVs used for 'shelter.' They may be supported by temporary housing - all of which costs taxpayers billions annually.

Or we must have many more federally regulated HUD Code manufactured homes. Modern manufactured homes do not look like the mobile homes or trailer houses of decades ago. See the "evolution" image further below.

That's not just this writer's view, nor merely the view of properly informed AI. Federal Reserve system researchers and other economists have been publishing reports since 2018 that point to several of the same concerns.

  • National Association of Home Builders (NAHB): The NAHB, via President Buddy Hughes’ July 30 statement praised the Act’s zoning reforms but raised concerns about competitive impacts on site-built housing. “NAHB applauds the Senate Banking Committee for passing a bipartisan housing package to fix the housing crisis by addressing our nation’s critical lack of housing supply,” said NAHB Chairman Buddy Hughes. “Building more homes is the only way to ease America’s housing affordability crisis, and the ROAD to Housing Act includes favorable provisions aimed at zoning and land-use policies, rural housing and multifamily housing that will stimulate construction of sorely needed housing.” See Part I of the report linked here for more.
  • National Association of Realtors (NAR): NAR, through CEO Shannon McGahn’s linked here, said the following. "In a letter to committee chair Tim Scott (R–S.C.) and ranking member Elizabeth Warren (D–Mass.), the National Association of REALTORS® expressed its strong support for the bill.

“We commend your leadership in crafting this landmark, comprehensive piece of legislation that addresses the full spectrum of housing needs while prioritizing pathways to homeownership for American families,” the letter stated. “NAR previously endorsed many of these provisions as standalone measures, and we appreciate this collaborative approach to addressing our nation’s housing challenges.”

The Manufactured Housing Institute (MHI), via July 30 email linked here, said this.

"The prominence of having a separate title and being in the top three titles of the bill highlights Congress’s support for the industry. There are four sections to Title 3, and MHI’s proposal to remove the statutory language requiring manufactured homes to be built on a permanent chassis is the first (Section 301)."

But MHI failed to mention the Manufactured Housing Improvement Act (a.k.a.: MHIA, MHIA 2000, 2000 Reform Law, 2000 Reform Act). That is odd at best given that MHI members testified to Congress in 2011, 2012, and 2023 that the “enhanced preemption” provision of that 2000 Reform Law was not being properly enforced.

Multiple MHI members are under fire for allegations of predatory and monopolistic behavior. They apparently like the status quo. That may explain why they are supporting a bill that keeps the status quo intact.

But the bad behavior of a several larger companies should not be a reason to reject the solution that many third-party researchers have revealed is the only way to solve the affordable housing crisis with inherently affordable manufactured homes.

Without homes that are so affordable that they do not requires subsidies, the housing crisis can't be solved. Pretty words and piles of political promises won't do it. 50 years of evidence has proved that point. Besides, third-party research has debunked the common concerns about modern manufactured homes. “More Red Flags for the Industry and Consumers in the Second Trump Administration” – Mark Weiss, J.D., MHARR Issues and Perspectives.

"MHARR stressed that the industry (i.e., the broader industry, represented by the Manufactured Housing Institute), during the first term of Donald Trump’s presidency, had missed a golden opportunity to address and correct – once and for all – the major policy/regulatory bottlenecks that have combined to needlessly stunt the growth and continuing evolution of the HUD Code manufactured housing industry for far too long. Rather, MHARR said at the time, “it is up to the entire industry and all of its representatives to seek, demand, and achieve the reforms” needed to eliminate those bottlenecks, “that are clearly needed to unleash the industry’s full potential and cement its place as the nation’s premier source of affordable non-subsidized homeownership.”
