Thomas M. Joy, 33, of Loudon Road Concord was arrested at 4:22 p.m. on April 19 on resisting arrest or detention and three criminal mischief charges. Officers were sent to an apartment on Loudon Road for a report of a domestic. A woman stated her ex-boyfriend was at his apartment, throwing her belongings into the front yard. The officers saw several items scattered on the ground and the woman was gathering them. The woman accused Joy of damaging her property. The pair lived together for about four months, she said. The woman accused Joy of appearing at her place of employment, too, and causing a scene. Later that day, things escalated. The officer estimated the damaged items were around $110. The report said the officers went to speak with Joy but received no response when knocking on the apartment door or calling his cellphone. The woman then let the police into the apartment but could not find Joy. The reporting officer said clothes and furniture were scattered throughout the living room and kitchen, and several open alcoholic beverage containers were seen in the kitchen. Officers found him later sleeping and attempted to wake him, the report stated. After prodding, Joy woke up and said, “What the f--- are you doing in here?,” the report stated. When it was explained they were investigating damaged property, the officer accused Joy of screaming more, with slurred speech, while smelling like alcohol. “Every time I attempted to speak with Thomas, he would yell over me and state, ‘Bye!’ and ‘Get the f--- out of my apartment,’” the officer said. After a lot of yelling, police began to take Joy into custody, the report said, but he clenched his fists and resisted. After being asked to cede and put his hands behind his back “several times,” and Joy refusing, one officer unholstered and activated a Taser, an affidavit said. After that, “Thomas stopped resisting,” the officer wrote. Joy was accused of being hostile and screaming, so he was taken to county. There, he screamed at correctional officers and called one a “c---” while trying to “square up” with them, an affidavit stated.
