Around 7:45 p.m. on Aug. 31, police were sent to Concord Street for a possible domestic violence order violation. A man reported receiving phone calls from a number he did not recognize, happening “multiple times a day,” according to an affidavit. He accused Mercier of calling him in the past and revealed they had a phone conversation recently about her upcoming birthday, the report stated. The officer checked the phone history, asked some questions about the call activity, and then went to meet Mercier at her campsite behind the Everett Arena. Mercier, the report stated, denied calling the man and said she understood there was an order against her. When asked to look at her cellphone, the officer stated it was dead. The officer told Mercier that they would be seizing the phone and requesting a search warrant. “Nichole became aggressive and hostile in nature,” the officer wrote. Later, however, she admitted to calling the man on Aug. 30 and confirmed the number she was using, the report said. When asked if she was the only person using the phone, she replied, “Yup! What are you going to do? Arrest me?,” the affidavit stated. The officer checked the order, found it was active, and issued a warrant for Mercier’s arrest.
