Michael J. Depont, 41, a homeless man now located in Concord, was arrested at 9:15 a.m. on Oct. 28 on a felony possession of a controlled drug and carrying or selling weapons charges as well as a warrant. Police were sent to the CVS at 4 Hall St. for a report of several homeless people arguing in the parking lot and carrying building materials, apparently to build a camp site. The store employee, who reported the argument in the lot, said they had received “several complaints” from customers about the people in the lot. When the reporting officer arrived, only one person was remaining, Depont, according to a report. A check of Depont found he had a Concord police warrant on a simple assault charge, and he was arrested. There was a backpack at Depont’s feet and he confirmed it was his and he wanted it taken to headquarters with him, an affidavit said. When asked if he had any weapons or sharp objects, Depont was accused of appearing flustered and nervous and advised there was a capped needle and a knife in his sweatpants pockets. The officer searched Depont, found a clear baggie with three clear rock crystals inside, believed to be meth, and five brownish rocks, which appeared to be heroin, the affidavit said. The officer accused him of having metallic knuckles in his backpack. He was arraigned in Merrimack County Superior Court on Nov. 16 and is due back in court for a dispositional conference on Jan. 16, 2024.
