NH Man Indicted On Deadly Weapon, Stolen Property Charges: Superior Court Roundup

Franklin man indicted on burglary charges; Penacook man accused of assaulting corrections officer; drug dealing indictments in Concord.

CONCORD, NH — The following people were indicted recently in New Hampshire.

Nicolas W. Dawes, 30, of Franklin, incarcerated at the time of the indictment, on felon in possession, two burglary, and two possession of controlled drug charges, fentanyl and methamphetamine, all felonies. The weapon (a revolver) and drug charges were connected to an incident in Franklin on July 26, the indictment said. The burglary charges were connected to incidents on July 24 and July 25 at the city’s municipal services department building on West Bow Street in Franklin.

Anthony W. Deforge Sr., 51, a homeless man now located in Franklin, on a controlled drug act; acts prohibited-meth charge on June 8.

Justin Dutton, 40, of Four Seasons Lane in Merrimack on reckless conduct with a deadly weapon and receiving stolen property, $1,501+, felony counts as driving after suspension and disobeying an officer charges. He was accused of stealing a BMW, and driving it recklessly on Interstate 93 through Concord at more than 100 mph on July 16, while having a suspended license and refusing to stop for police. Kaleb Ferland, 31, of Penacook, incarcerated at the time of the indictment, on three felony assaults by prisoners charges. He was accused of repeatedly assaulting a corrections officer at the Merrimack County Jail in Boscawen on Aug. 11.

Justin L. Fleming, 33, of Cram Hill Road in East Swanzey on two felony controlled drug act; acts prohibited, meth and fentanyl, charges on Feb. 4, 2021, in Hooksett.

Jeremy Fortin, 40, of Village Street in Penacook on two controlled drug act; acts prohibited-meth and buprenorphine with intent to distribute, three controlled drug act; acts prohibited-meth, crack cocaine, and cocaine, and two falsifying physical evidence charges, all felonies. He was accused of acting in concert with Tiffany Labonte on the meth-dealing charge, according to the indictment. In one of the evidence charges, Fortin was accused of removing a baggie and giving it to Zachary Albert, the indictment stated. The charges stem from incidents in Concord on June 16 and June 29. Tracey Scott Francia, 60, of Concord, with a mailing address on North Main Street, on two felony sale of narcotic drugs charges. She was accused of selling cocaine on Hall Street on April 19 and May 19.

Randall P. Francis, 44, of Nathan Cutler Drive in Bedford on controlled drug act; acts prohibited-meth and receiving stolen property charges, both felonies. He was accused of retaining a 2014 Nissan Versa that he knew to be stolen on July 19 in Concord. Mark W. Fuller, 39, of Switch Road in Andover on felony operating a motor vehicle after certification as a habitual offender and driving after revocation or suspension charges. He was accused of driving a 2008 Suzuki GSX motorcycle on May 31 on Route 11 in Andover after being certified as a habitual offender by the NH DMV. Previously, according to the indictment, Fuller was convicted on a habitual offender charge in Belknap County Superior Court in October 2021.

Ashton E. Garland, 31, a homeless man now located in Concord, on two felony controlled drug act; acts prohibited, fentanyl and para-fluorofentanyl and LSD, charges, in Concord on Aug. 5.
