Man Indicted For Stealing Nearly $10K From Dunkins In Chichester, Loudon, And Pittsfield: County Indictments

CONCORD, NH — A grand jury in Merrimack County recently indicted the individuals listed below.

Fabio Baez, 27, incarcerated in the New Hampshire State Prison for Men in Concord at the time of the indictment, on a felony count of assaults by prisoners. He was accused of striking a corrections lieutenant in the abdomen on May 3, 2024.

Andrew Beck, 46, of Balch Farm Road in Bennington, on two felony counts of controlled drug act; acts prohibited, fentanyl and methamphetamine, on July 12, 2025, in Bow.

Benjamin Berry, 31, of South State Street in Concord, on three felony counts of theft by unauthorized taking. He was accused of stealing merchandise from Marshalls in Concord on April 6, 2025, Market Basket in Concord on April 11, 2025, and Target in Concord on Feb. 3. Twice before, according to the indictment, Berry has been convicted on theft charges.

Michelle Brien, 47, of Laurel Street in Concord, on a felony count of possession with intent to distribute-fentanyl on Oct. 4, 2024, in Concord.

Benjamin Bryant, 41, of Diana Road in Northfield, on a felony possession of meth charge on Sept. 3, 2025, in Northfield.

Heather L. Yost, 34, of Woodlawn Drive in Allenstown, on possession of fentanyl and possession of meth charges, both felonies, on Nov. 21, 2025, in Pittsfield.

James R. Marhevka, 46, of Elm Street in Manchester, on a felony theft by unauthorized taking charge. He was accused of stealing $9,996.21 from Dunkin’ Donuts franchises on Suncook Valley Road in Pittsfield, Route 106 in Loudon, and Horse Corner Road in Chichester between Sept. 12 and Sept. 15, 2025.

Howard C. Swenson, 62, of Youngs Hill Road in Loudon, on a felony aggravated driving while intoxicated charge. He was accused of driving on Loudon Road in Pittsfield while under the influence and causing a collision with serious injury, a bone fracture to his right leg, on Feb. 9, 2025, in Pittsfield.

Phillip R. Mullen, 33, of Main Street in Pittsfield, on a felony motor vehicles; penalties charge. He was arrested on driving on Chestnut Street in Pittsfield on Oct. 16, 2025, after being deemed a habitual offender by the NH DMV in November 2022.

Barry English, 39, of Nashua, incarcerated in the Merrimack County Jail in Boscawen at the time of the indictment, on two felon in possession, six delivery of articles prohibited, and two falsifying physical evidence charges, all felonies. He was accused of possessing a vape, an electronic SIM card, a cellphone, meth, cash, a broken mop top, and a sharpened broom handle, between Oct. 9, Oct. 11, and Nov. 26, 2025. On Oct. 9, 2025, he was accused of putting meth in his mouth to impair an investigation and threw a cellphone or vape behind a wall outside his cell on to impair an investigation on Nov. 26, 2025.

Brianna L. Harris, 35, of Hanover Street in Manchester, on three felony counts of assaults by prisoners. She was accused of urinating in her cell at the Merrimack County Jail in Boscawen after threatening three corrections officers that she was going to spread urine, feces, and menstrual blood in her cell and force them to clean it up afterward on Jan. 19.

Christopher M. Palermo, 49, of Franklin Highway in Andover, on a felony duty to report charge. He was accused of failing to register with Andover police on May 19, 2025. Palermo, according to the indictment, is a sex offender due to an aggravated felonious sexual assault conviction in September 2012 in Hills South.
